These Terms of Service (“Terms”) are a binding agreement between you and VoiCore (“VoiCore,” “we,” “us”) governing your access to and use of the VoiCore platform, websites, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.
If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to that organization. If you do not agree to these Terms, do not use the Service.
VoiCore provides software for placing and receiving AI-assisted voice calls, including campaign dialing, lead qualification, call transfer, recording, transcription, and related analytics. We may update, add, or remove features over time.
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity under your account. Notify us promptly of any unauthorized use.
We may offer a free trial for a limited period. We may modify or discontinue trials at any time. Unless you cancel before the trial ends, your subscription may begin and applicable fees may apply. Trial usage remains subject to these Terms.
You agree not to use the Service to: violate any law or third-party right; transmit unlawful, fraudulent, harassing, or deceptive content; impersonate any person or entity; attempt to gain unauthorized access to or disrupt the Service; reverse engineer the Service except as permitted by law; or use the Service to build a competing product. We may investigate and take action, including suspension, for violations.
You are solely responsible for compliance with all laws and regulations governing your calls, messages, and recordings. This includes, without limitation, the U.S. Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, state telemarketing and do-not-call laws, call-recording consent laws, and any applicable rules in the jurisdictions you call.
You represent and warrant that you have obtained and will maintain all legally required consents before contacting any person through the Service, that you will honor do-not-call and opt-out requests, and that you will only call individuals you are legally permitted to contact. VoiCore provides tools such as calling-window controls, consent tracking, and suppression lists to help you operate compliantly, but VoiCore does not guarantee compliance, does not monitor the lawfulness of your campaigns, and does not provide legal advice. You are responsible for configuring and using these tools correctly.
“Customer Data” means data you submit to the Service, including contact lists, lead information, call recordings, and transcripts. As between the parties, you own Customer Data. You grant us a worldwide, non-exclusive license to host, process, and use Customer Data solely to provide and improve the Service and as described in our Privacy Policy. You are responsible for having the rights and consents necessary to provide Customer Data to us.
The Service, including all software, content, and trademarks, is owned by VoiCore or its licensors and is protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service. We retain all rights not expressly granted.
The Service integrates third-party providers (for example, AI model, telephony, payment, and infrastructure providers). Your use of those features may be subject to the providers’ terms, and we are not responsible for third-party services. We may add, change, or remove providers.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated output will be accurate or suitable for your purposes.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOICORE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You will defend, indemnify, and hold harmless VoiCore from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Customer Data, your calls or messages, your violation of these Terms, or your violation of any law or third-party right — including any claim relating to TCPA or other telemarketing, consent, or recording requirements.
You may stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or create risk or legal exposure for us or others. Upon termination, your right to use the Service ends. Sections that by their nature should survive (for example, fees owed, IP, disclaimers, liability, and indemnification) will survive.
We may modify these Terms from time to time. If we make material changes, we will provide notice (for example, by posting the updated Terms with a new date or by email). Your continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of [State / Country], without regard to conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the courts located there, except that either party may seek injunctive relief in any court of competent jurisdiction.
